1. Definitions

1.1 The provider is Exclusive Limousine Management Lindhofer GmbH.

1.2 Customer means any natural or legal person who commissions services from the provider.

1.3 Consumer (B2C) means a customer within the meaning of § 1 Austrian Consumer Protection Act (KSchG).

1.4 Business Customer (B2B) means a customer within the meaning of § 1 Austrian Commercial Code (UGB).

1.5 Services include all passenger transport, chauffeur, transfer, event, shuttle and tourism services provided by the provider.

1.6 Booking means any binding request via website, email, telephone, WhatsApp, agencies or other communication channels.

1.7 Chauffeur refers to the driving personnel of the provider or an assigned partner company.

2. Scope

2.1 These Terms & Conditions apply to all current and future contractual relationships between the provider and the customer.

2.2 Deviating or conflicting terms of the customer shall not apply unless expressly confirmed in writing.

2.3 These Terms & Conditions explicitly apply to cross-border journeys within the European Union and to and from Switzerland.

3. Nature of Services

3.1 The provider offers passenger transport services by car (taxi) without the use of a taximeter, as well as individually agreed chauffeur services.

3.2 Services are provided exclusively on the basis of a confirmed booking and do not constitute traditional metered taxi services.

3.3 There is no entitlement to a specific vehicle model, license plate or chauffeur unless expressly agreed in writing.

3.4 The provider reserves the right to deploy equivalent or higher-class vehicles.

4. Conclusion of Contract

4.1 All offers are non-binding.

4.2 A contract is concluded upon written confirmation of the booking or actual provision of the service.

4.3 Short-notice booking requests do not constitute a guarantee of service provision.

5. Use of Subcontractors

5.1 The provider is entitled to perform services wholly or partially through partner companies or subcontractors.

5.2 This applies in particular in cases of capacity shortages, technical issues or international journeys within the EU and Switzerland.

5.3 Subcontractors act as vicarious agents within the meaning of § 1313a Austrian Civil Code (ABGB).

5.4 The customer has no right to be informed about the specific use of subcontractors.

6. Prices and Fees

6.1 All prices are quoted in euros and include statutory VAT.

6.2 Prices are not published on the website.

6.3 Standard services are based on internal price lists, which are regularly reviewed and adjusted.

6.4 Individual services are calculated based on effort and requirements.

6.5 Toll and parking fees customary for the route, as well as water in the vehicle, are included unless otherwise agreed.

6.6 No surcharges apply for night, weekend or public holiday services.

7. Payment Terms

7.1 Payment can be made in cash, by debit/credit card or by invoice.

7.2 Invoices are payable immediately without deduction.

7.3 Tips are voluntary and not included in the fare.

8. Waiting Times

8.1 Airport

Flight number must be provided for tracking.

Included waiting time: 60 minutes from actual landing.

Additional waiting time will be charged in 30-minute increments.

8.2 Train Station

Included waiting time: 15–30 minutes from actual arrival.

Additional waiting time will be charged in 30-minute increments.

8.3 Address / Hotel / Pickup Location

Included waiting time: 15 minutes from agreed pickup time.

9. No-Show

9.1 A no-show occurs if no contact with the customer can be established after the waiting period.

9.2 In such cases, 100% of the agreed fee will be charged.

10. Changes to Services

10.1 Changes are subject to operational feasibility.

10.2 There is no entitlement to extension or expansion of services.

10.3 Additional effort will be charged separately.

11. Cancellation

11.1 Transfers

• Up to 24 hours before pickup: free

• Up to 12 hours before pickup: 50%

• Less than 12 hours: 100%

11.2 Hourly / Daily / Multi-day bookings

• Up to 72 hours before start: free

• Up to 48 hours: 50%

• Less than 48 hours: 100%

11.3 Events and larger bookings

30% deposit required.

• Up to 7 days: free

• Up to 72 hours: 50%

• Less than 72 hours: 100%

12. Right of Withdrawal (B2C)

12.1 No right of withdrawal applies to time-specific services pursuant to § 18 FAGG.

13. Conduct in the Vehicle

13.1 Smoking is strictly prohibited.

13.2 Water is permitted; other food and beverages only with chauffeur approval.

13.3 Excessive soiling or damage will be charged based on actual costs.

14. Animals, Luggage and Child Seats

14.1 Assistance animals are always permitted.

14.2 Other animals only with prior approval.

14.3 Special luggage must be declared in advance.

14.4 Child seats are provided free of charge but must be requested at booking.

15. Liability

15.1 The provider is liable only in cases of intent or gross negligence.

15.2 Liability for indirect damages, loss of profit or missed appointments is excluded.

15.3 Liability is limited to the order value to the extent permitted by law.

16. Force Majeure

16.1 Events of force majeure exclude claims for damages.

17. Confidentiality

17.1 The provider undertakes strict confidentiality regarding all customer and booking-related information unless disclosure is required by law.

18. Applicable Law and Jurisdiction

18.1 Austrian law shall apply.

18.2 This also applies to journeys within the EU and Switzerland.

18.3 Place of jurisdiction is Vienna, where legally permissible.

19. Severability Clause

19.1 Should individual provisions be invalid or unenforceable, the validity of the remaining provisions remains unaffected.
